Wise Voters in Oregon
That Oregon voters are probably the wisest in the nation is made manifest by the fact that on May 16, 2000 by a 3-to-1 margin, Oregon's electorate defeated "Measure 81," a ballot proposition that would have empowered state legislators, who of course receive thousands and thousands of campaign contribution dollars fom the insurance industry and the doctors' lobby, to limit the amount of monetary damages plaintiffs in medical malpractice and other tort lawsuits might receive.

It is probably too much to expect that the legislature of California and its governor would "get the message" from the overwhelming majority view of our northern neighbors.

Barrerra III v Clinic in Suburbia et al:
A five-month old infant was brought to an urgent care center, where medical personnel failed to diagnose and properly treat an ongoing septic condition. Bacteria was thriving in the fluid surrounding the brain and spinal cord, causing inflammation of the brain and spinal membrane, resulting 36 hours later in full-blown spinal meningitis with severe and permanent brain damage.
Settlement: $2,475,000

NEWS: Barton Friedman, son of Nathaniel J. Friedman, founder of this law firm, was awarded a nearly half million dollar settlement for his client in a birth injury case. The plaintiff, George Marquez, Jr., an infant, was injured during delivery overseen by Guillermo Gomez, MD, at Riverside County Regional Medical Center. The infant suffered a serious injury to his left shoulder.

The plaintiff, through his father, Jorge Marquez, alleged medical malpractice on the part of Dr. Gomez. The jury found that Gomez was negligent and awarded $477,674, an amount later modified in post trial negotiations.
